By accessing or using Rosed ("the Platform"), operated by Rosed ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

Rosed is an AI-powered influencer content platform that enables users to create, automate, and publish content across social media channels. The Platform includes web applications, APIs, SDKs, and related services.

3. Account Registration

To use certain features, you must create an account. You agree to provide accurate, complete information and keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws
• Generate or distribute content that is defamatory, obscene, or infringes on third-party rights
• Attempt to gain unauthorized access to the Platform or its systems
• Interfere with or disrupt the Platform's infrastructure
• Use automated tools to scrape or extract data beyond authorized API usage
• Resell or redistribute access to the Platform without written permission

5. Content Ownership

You retain ownership of content you create using the Platform. By using our services, you grant Rosed a limited, non-exclusive license to process and store your content solely to provide the services. AI-generated outputs are licensed to you for use in accordance with these Terms.

6. Intellectual Property

The Platform, including its design, code, features, and branding, is owned by Rosed and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Platform without written consent.

7. Payment and Billing

Paid plans are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees incurred. Prices may change with 30 days' notice. Refunds are provided only as described in our refund policy.

8. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may cancel your account at any time through account settings. Upon termination, your right to use the Platform ceases and we may delete your data after a reasonable retention period.

9. Disclaimers

The Platform is provided "as is" without warranties of any kind. We do not guarantee that AI-generated content will be accurate, appropriate, or free of errors. You are responsible for reviewing all content before publishing.

10. Limitation of Liability

To the maximum extent permitted by law, Rosed shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or a notice on the Platform. Continued use after changes constitutes acceptance of the updated Terms.
